Puppy Purchase Agreement

This legally binding contract is entered to by and between Tina Winston “Seller” and  ___________________________________ “Buyer” for the purchase of a Toy/Miniature Australian Shepherd/Miniature American Shepherd puppy (the "Puppy").

1.  Non Refundable Deposit.  A deposit of Seven Hundred Fifty Dollars ($750) is required to reserve the Puppy.   The remaining balance is due prior to the puppy leaving our home if the puppy is being picked up in person.  If arrangements have been made for the delivery of the puppy by Flight Nanny, the remaining balance is due twenty four hours prior to the flight.

The Seller takes great pride in the meticulous care and attention provided to the Puppy prior to its departure.

1. Initial Health Guarantee: The Seller guarantees the Puppy to be in good health and free of communicable diseases on the date of delivery/pickup. The Puppy will be current on all age-appropriate vaccinations and come with a complete copy of its veterinary records.
2. Buyer's Obligation (72-Hour Check): The Buyer must have the Puppy examined by a licensed veterinarian within 72 hours of the transfer of possession. If the veterinarian finds the Puppy to be unsound, the Buyer must notify the Seller within 24 hours of the examination.
3. Exclusions: This warranty does not cover minor, treatable conditions common to puppies under the stress of transition, including but not limited to: internal parasites (e.g., Coccidiosis, Giardia), kennel cough, or minor diarrhea.
4. Continuing Care: The Buyer agrees to ensure the Puppy continues to receive all necessary and age-appropriate vaccinations (such as Distemper, Parvo) and veterinary care throughout its life.

MarLoWin Aussies warranties the Puppy against genetic defects that would prevent the dog from being a companion animal, specifically covering: Hereditary Cataracts (HC), Hip Dysplasia, Deafness, and other serious inherited eye defects for one (two) year from the date of purchase.

1. Verification Requirement: In the event a covered defect is suspected, verification will require a non-pass CERF Evaluation by a Board Certified Veterinary Specialist (e.g., a Board Certified Veterinary Ophthalmologist for eye defects) must be provided by the Seller.  
2. Remedy: If a covered genetic defect is confirmed, a replacement puppy of comparable quality will be provided to the Buyer at the Seller's discretion. No cash refunds will be offered.

1. Registration: The Puppy will be registered with either the American Kennel Club (AKC) or is registered with the American Stock Dog Registry (ASDR). The Buyer will receive an AKC or ASDR Limited Registration for the Puppy.  The type of registration will depend on where the parents are registered and the plans for the puppy.
2. Breeding Rights: The Puppy is sold strictly as a companion animal. Breeding rights are not conveyed unless expressly stated in a separate, written addendum to this contract.

1. Registered Name: The Buyer is required to use "MarLoWin" as the prefix (beginning) of the Puppy's registered name. The remainder of the name is at the Buyer's creative discretion, provided it is in good taste.
2. Return/Rehoming Policy: It is the Seller's sincere intention that none of our dogs ever end up in a shelter. If, at any time in the future, the Buyer is unable to keep the Puppy/Dog, MarLoWin Aussies will provide assistance in finding a suitable new home. The Buyer agrees to notify the Seller immediately should they be considering rehoming the dog.
